" The legal system seems a travesty at this point in time. Kudos to the pathologist whose blunt testimony left no room for doubt as to the animal brutality which absolutely had transpired during this cold blooded murder of Kelly Kuykendall. Although it appears cut and dried as to the sole perpetraitors of same per witnesses, even IF they are found guilty the punishment certainly does't fit the heinous crime! "

" As a family member to Kelly, I have confidence that justice will prevail as long as we're patient and have trust and faith that the system will do what it is supposed to. Based on the criminal report alone, neither of these guys will walk away without being punished - probably to the fullest extent now that a trial looks imminent - since they both confessed, albeit in a roundabout way, to everything that happened that night... everything. Though I hate to speak for everyone in my family I believe everyone would agree with me, especially when setting aside the traumatic feelings this tragedy has brought us. "

" The "farm work" excuse is a joke! It's so sad this so called "investigation" is being taken seriously by Vernon Co. and all who want to believe justice will prevail in this fiasco! David's Father works for the Rail Road and never has been a full time farmer in his life. (ever hear of a "hobby farm?") This so called "family farm" has been in the family a very long 4 or so years at the most!. (is there an award coming up for this one) Wake up Vernon County! Anyone up for election this year that can make a difference for the next mess like this???

" How SAD
What is wrong with this Judicial System? I hope they ask for a change of venue. This will never be a fair trial. You can see that already by the two Heisz boys still walking the street or tobacco fields. Maybe they should both be required to find real jobs and go to them by the huber law. Out on bond what a joke. Like not a care in the world. "

" Something is really wrong here!
Would it be wrong if the district attorney asked for a Judge change?
Wisconsin needs to wake up to Vernon county, from what I see normal people are being intimidated, harassed and down right feel like there is no justice in their county. A man was killed there recently and the killer and his co-partner are still walking the streets these people want to raise their children on. The judge not only gave David free run of all Wisconsin (coming to your neighborhood soon) he also said all and any help to his father farming should be considered as employment. They must have bright lights on that tractor to be able to farm tobacco until 11:00 PM every night. I wonder if David will pay taxes on the money he makes on the farm from his dad. Oh wait I forgot us tax payers will cover this for them while he is in prison; we'll probably even pick up his living expenses and child support. I best liked the district attorney statement Kelly's family wont be able to get his help farming.
God bless us all,
Love always his little brother Kris

Faith in Justice? wrote on Apr 2, 2008 4:08 PM:
" Personally, I don't believe that having faith is believing something will happen just because we want it to. I don't believe that because something is just and right, that this is always what happens in our criminal justice system.
I've only had one personal experience with our justice system, and unfortunately it did everything except instill "faith" in me that justice will be served. I was the victim of domestic abuse. My only crime was that I made a wrong decision when I chose to marry my ex-husband. I filed for divorce and obtained an order of protection, which was totally useless. He consistently violated this order and the police told me that they couldn't ever "find him." He would hire people I wouldn't recognize to follow me home from work so he could see where I was living, which resulted in countless job changes and moves to try and stay out of his reach. He seemed incredibly adept at securing what was supposed to be privileged information. Several years later, when applying for a job or even a house mortgage, I am still asked to explain the numerous changes/"gaps" made during that period in my life. It is not uncommon for them to look at me like I am the criminal.
I eventually had to go into "hiding" with strangers as I could not put my friends and family at risk. Unfortunately,(and I still don't know how) he found me and actually tried to murder me. The police eventually found him and he had a "hearing." Although he had taken away my freedom for years, he was not even sentenced to one day of jail time. He was given several "provisions" such as he was told to make monetary restitution for property he destroyed and was placed on probation. To this day he has not followed even one of the provisions of his sentence, nor suffered any repercussions for not doing so. I had an attorney look into this and he was told by our "justice system" that it was best to just let it be. They then told him it was best not to do anything to upset him, and maybe now he would "forget" and would leave me alone. So much for "justice." This happened several years ago and did not happen in Vernon County. I just hope that our criminal justice system here is much more "just" than what I have experienced elsewhere. Unfortunately, already in this case, I am seeing things that make me question that justice will prevail here. This gives new meaning to the phrase "eternal vigilance." "

" I find it very hard to believe that David's defense would be that he fell on him and caused the injuries since witnesses saw him forcefully push him down the steps. I still can't understand why Mikeal isn't charged with more since he was the instigator in the whole episode by pushing Kelly off of his bar stool. I don't care what words were said about his father (Mikeal's) There is no reason to freak like that!! "

" It is desperately sad that his children will have to grow up w/him in prison, but on the other hand Kelly's children and grandchildren will be growing up without him in thier lives forevermore. I do believe it is common public knowledge, that at least monitarily, David has not even been responsible for his own children. How sad. As for having a "LIFE" right now, please, he has more freedoms than most regular folks do. He should be locked up awaiting his trial, and as for his $10,000 bond, I have seen people pay more to get out of jail on alleged animal cruelty charges with no eye-witnesses whatsoever! May God protect our family from this court system, because apparently... we are going to need it! "

" Ok I realize that none of you are lawyers, however I am familiar with the legal system.. It doesn't matter if the judge entered the plea or not, there will be a jury trial I am sure and well the truth will be told and he will be sentenced with what he deserves... whether he meant to do it or not... A family is now missing a very important person in their lives... "

" As in a Grant co murder case that commenced in 2006 The defendant stood mute as well. The judge also entered a plea of not guilty, it is common practice. This gives the attornies time to hash out some kind of plea deal so they dont have to go to court most of the time, or to see if they have enough evidence.
In the forementioned Grant co case the defendant plead guilty to second degree intentional homicide and received 25 years in prison and 20 years supervision for the death of his 17 year old wife whom he confessed to stabbing to death. "
Vernon County Asks for Justice wrote on Apr 1, 2008 8:18 AM:
" I find it ironic that David Heisz didn't even enter his own not-guilty plea. Why did the judge do it for him? Is this common practice in court? True remorse for actions taken includes being willing to own up to what we do and face the consequences. It's apparent that is not the case here. It would never bring Kelly back, but it would mean justice at least to the degree that you can have when someone is murdered. It also might help both families and the community as a whole, heal. I find it outrageous that this man pleaded "not-guilty." Also, what is up with the term "possible trial?" How on earth could there be any question as to whether there will be a trial or not and why is it taking 5 months? Although I can't imagine being out on bail is true freedom after what he did, I also can't fathom that he plead "not-guilty." Maybe his punishment should be at the same level and degree as his non-existent remorse and willingness to face the consequences of his actions. "

Add another 25# to D and take a few off Kelly to make it sound like he could have hurt him even more by falling on him. (then again, everyone is due their day in court) I wonder how much he'll weigh by June?
